Terms & Conditions

Effective Date: 21 August 2026  ·  Updated 4 November 2026  ·  Please read carefully before using hApItal

1. Acceptance of Terms

These Terms and Conditions govern your use of the hApItal mobile application and any related services provided by Hapitech Technologies LLP (“hApItech”, “we”). By creating an account or booking an appointment through hApItal, you confirm that you have read, understood, and agree to be legally bound by these terms in their entirety, along with our Privacy Policy. If you do not agree to any part of these terms, you must immediately discontinue your use of the platform.

2. Nature of the Platform

hApItal is a technology-based appointment marketplace and emergency services directory that enables patients to discover independently practising doctors, schedule consultations, and locate nearby emergency service providers including ambulance services, hospitals, blood banks, oxygen suppliers, and twenty-four-hour pharmacies. hApItech is not a healthcare provider, hospital, clinic, or medical institution. We do not employ the doctors listed on our platform, and we do not provide, supervise, or endorse any medical advice, diagnosis, treatment, or prescription. The doctor you book with is solely and entirely responsible for the medical care they provide during your consultation. hApItal's role is limited to facilitating the connection between you and the doctor, and to surfacing relevant local emergency resources as a directory service.

The platform may display promoted listings of certain doctors who have opted into a paid promotional feature. These promoted listings appear as part of the regular discovery experience and are not presented in a misleading manner. Promotion does not imply that hApItech endorses any particular doctor's services over those of any other doctor on the platform. All listed doctors are subject to the same credential verification process regardless of whether they participate in promotional listings.

3. Eligibility

To register as a patient on hApItal, you must be at least eighteen years of age; your date of birth is asked and checked at sign-up. Anyone under eighteen may not register themselves; a parent or legal guardian may add them as a family member and book for them, and by doing so confirms they are the parent or guardian and gives consent on the child’s behalf. You are permitted to book appointments on behalf of family members, including minors, using your own account. When booking for a family member, you must provide accurate information for that family member, including their name, age, and gender. Each mobile number may be associated with a single account only. By registering, you represent and warrant that the information you provide is accurate, current, and complete, and that you are legally capable of entering into a binding agreement under applicable Indian law.

4. Booking Appointments

When booking an appointment through hApItal, you are required to provide accurate and complete information, including your name, age and gender, and any symptom note you choose to add. A booking through the platform constitutes a request to the doctor, not a guaranteed confirmed appointment. The doctor retains the right to accept, decline, or reschedule your booking, and you will be notified in such cases. All appointment times are displayed and interpreted in Indian Standard Time.

Where a doctor has configured time-based appointment slots, you will be able to select a specific available slot during the booking process. Each slot has a fixed capacity set by the doctor, and a booking is only permitted when capacity is available within that slot. Upon confirming your booking, you will be assigned a token number reflecting your position in the queue for that slot. Your token number is visible in your appointment details and is also sent to you by notification. The token number is provided for your convenience in understanding your approximate sequence in the queue and does not guarantee a precise consultation time within the slot.

You are responsible for presenting yourself at the clinic at the scheduled time. hApItech is not responsible for any inconvenience arising from a patient's failure to attend a confirmed appointment.

5. Notifications

When you first use the hApItal application, you will be asked for permission to send push notifications to your device. hApItal uses notifications to tell you about your appointments: a booking confirmation and your token number, an appointment reminder, a re-checkup reminder if your doctor recommends a follow-up visit, a notice if a doctor cancels or moves your appointment, and a notice when a prescription or medical document is ready to view. Appointment updates are sent as push notifications and also appear in the app’s notification list; they are not sent by SMS or WhatsApp. Your login code is sent on WhatsApp (or by SMS if WhatsApp cannot be reached). You may turn off notification permission at any time in your device settings; you can still book appointments, but you may miss updates about your bookings. hApItech sends you updates and offers about hApItal, by WhatsApp or e-mail, only if you tick “Send me hApItal updates & offers”; you can turn this off at any time in Profile or by writing to hapitechops@gmail.com. This choice never affects appointment notifications.

6. Location Permission

When you access the ambulance or emergency services section of the hApItal application, you will be prompted to grant location permission. This permission is requested for the sole purpose of determining your approximate current location and displaying nearby emergency service providers sorted by distance from you. Your location is used in real time to calculate these distances and is not stored or shared beyond the immediate session. You may decline to grant location permission and instead search for services by entering a location manually, though distance-based sorting will not be available in that case. You may revoke location permission at any time through your device settings.

7. Cancellations and No-Show Policy

You may cancel a booked appointment at any time before the scheduled consultation time through the hApItal application. We encourage you to cancel as early as possible so that the appointment slot can be made available to other patients. In the event of a repeated pattern of no-shows, where appointments are booked without cancellation and without attendance, hApItal reserves the right to temporarily restrict your ability to make further bookings. hApItal does not collect consultation fees, so any question about a fee you paid to a doctor or clinic is between you and that doctor or clinic.

8. Consultation Fees

Booking through hApItal is free for patients. hApItal does not take payment for consultations: you pay any consultation fee directly to the doctor or clinic, in the way they accept. The fee shown on a doctor’s profile is set by the doctor and may change; the doctor or clinic decides the final fee and any refund.

9. Prescriptions and Medical Documents

Prescriptions issued through the hApItal platform are generated exclusively by the treating doctor and are entirely the doctor's medical and legal responsibility. hApItal provides a digital delivery mechanism for prescriptions as a convenience feature only. You should always confirm your prescription directly with your doctor before acting upon it. hApItal and hApItech bear no liability for any errors, omissions, or consequences arising from a prescription issued by a doctor on the platform.

In addition to typed prescriptions, your doctor may upload supporting documents — such as a scanned prescription, lab report, or medical certificate — to accompany your consultation. Where such a document has been shared with you, it opens through a secure link that expires after a short time; you can open it again from the app while it is available. We encourage you to save or download important medical documents. hApItech does not make these documents publicly accessible, and access to them requires the secure link generated specifically for your appointment.

Your doctor may send you a re-checkup reminder through the platform if a follow-up visit is recommended following your consultation. These reminders are sent as a clinical courtesy and do not constitute a medical obligation. You are not required to respond to or act upon a re-checkup reminder.

10. Emergency Services Directory

The emergency services section of the hApItal application displays a directory of local service providers including ambulance services, hospitals, blood banks, oxygen suppliers, and pharmacies. This directory is provided as a convenience resource only. hApItech does not operate, employ, or endorse any of the service providers listed in the directory, and does not verify their real-time availability, response times, or service quality. In the event of a life-threatening emergency, you must call 112 immediately. Do not rely on this directory as a substitute for emergency medical services. hApItech bears no liability for the accuracy, availability, or response of any third-party service provider listed in the emergency services directory.

11. Medical Disclaimer

No information available on the hApItal platform, including doctor profiles, symptom guidance, the emergency services directory, or any other content, constitutes medical advice of any kind. In the event of a medical emergency, please call 112 immediately or go to the nearest hospital emergency department. hApItal is not intended for use in emergency medical situations, and you must not rely on this platform in circumstances where prompt professional medical attention is required.

12. Reviews and Ratings

Following a completed appointment, you may submit a review and rating for the doctor you consulted. Reviews must be based on your genuine personal experience and must not contain false, defamatory, offensive, or abusive content. hApItal reserves the right to remove reviews that violate these guidelines or that appear to be fraudulent. Submitting a review does not entitle you to any compensation or benefit.

13. Prohibited Conduct

You agree not to misuse the hApItal platform in any way. Prohibited conduct includes, but is not limited to, creating multiple or fraudulent accounts, providing false or misleading personal or medical information, booking appointments with no intention of attending, submitting false reviews, or engaging in any behaviour that harasses, threatens, or abuses any doctor, patient, or member of the hApItech team.

14. Account Suspension and Termination

hApItech reserves the right to suspend or permanently terminate your account at any time, with or without prior notice, if you violate any of these terms, engage in fraudulent or abusive conduct, or if your continued use of the platform poses a risk to other users or to the integrity of the service. hApItech may also block or remove an account that is fake, used for fraud or abuse, or must be removed under a court, government or police order. You may delete your own account at any time in the app (Profile → Delete my account) or at hapital.in/delete-account; it is deleted three days after you confirm, and you can cancel until then. Some records are kept after deletion as described in our Privacy Policy.

15. Limitation of Liability

hApItech's liability under these terms is strictly limited to its role as a technology intermediary facilitating appointment bookings and displaying a directory of emergency service providers. hApItech is not liable for the quality, accuracy, or outcome of any medical consultation or treatment provided by any doctor on the platform, for the availability or response of any emergency service provider listed in the directory, for any missed, delayed, or cancelled appointments, for any health outcomes whether positive or adverse, or for any indirect, incidental, consequential, or punitive losses of any nature arising from your use of the platform. To the fullest extent permitted by applicable law, hApItech's maximum aggregate liability to you shall not exceed the amount, if any, that you paid to hApItech in the twelve months before the event giving rise to the claim.

16. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, or controversy arising out of or in connection with these terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts located in Palanpur, Gujarat, India. Before initiating any legal proceeding, we encourage you to contact our support team, as many disputes can be resolved amicably and efficiently through direct communication.

17. Contact

For any questions or concerns regarding these Terms and Conditions, please contact hApItech at hapitechops@gmail.com or call +91 8320014893.
