Terms & Conditions

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you, the registered doctor, and hApItech. By completing the registration process and creating a doctor account on hApItal, you confirm that you have read, understood, and agree to be bound by these terms in their entirety, together with our Privacy Policy. If you do not agree to any part of these terms, you must not register or continue to use the platform.

2. Eligibility and Medical Credentials

To register as a doctor on hApItal, you must hold a recognised medical degree, such as MBBS or its equivalent, and a current, valid medical registration issued by the Medical Council of India, the National Medical Commission, or the relevant State Medical Council. Doctors who list a specialist qualification must hold an appropriate post-graduate degree recognised under Indian medical law for that specialty. By registering, you represent and warrant that all credential information you provide is accurate and up to date, that your medical registration is valid and not subject to any suspension, cancellation, or disciplinary action, and that you are legally authorised to practise medicine in India. hApItech may verify your credentials at any time and reserves the right to suspend your account if any discrepancy is found.

As part of the verification process, you will be required to upload a copy of your medical registration certificate through the platform. By doing so, you confirm that the document is a genuine, unaltered copy of your current certificate. This document is stored in private encrypted storage and is reviewed by hApItech's review team for the sole purpose of confirming the validity of your registration. It is not shared with patients or any third party.

3. Profile Accuracy and Maintenance

You are solely responsible for the accuracy, completeness, and currency of all information displayed on your hApItal profile, including your name, medical specialty, clinic name and address, consultation fee, and availability schedule. You must update your availability promptly whenever your schedule changes to avoid patients booking appointments you are unable to honour. If you have configured time-based appointment slots, you are responsible for ensuring that your slot schedule accurately reflects the days and times on which you are genuinely available to see patients, and for blocking any specific slots you cannot honour using the slot management feature in your dashboard. Profile photographs must be a clear and recent photograph of the doctor personally. The use of clinic exterior images, logos, or stock photographs as a profile photo is not permitted. hApItech reserves the right to request that inaccurate, misleading, or inappropriate profile content be corrected, and to suspend the profile of any doctor who fails to comply.

4. Appointment Obligations

By registering on hApItal, you agree to make genuine efforts to honour all appointments booked through the platform. If you are unable to attend a confirmed appointment due to an emergency or unforeseen circumstance, you must cancel or reschedule it through the platform as promptly as possible so that the patient can be notified in a timely manner. A pattern of repeated cancellations or failure to respond to confirmed bookings may result in the temporary suppression of your profile from patient search results or the suspension of your account.

Where you have configured time-based appointment slots, only patients who book within an available slot and within the capacity limit you have set will be able to place appointments for that time. Each booked appointment within a slot is assigned a token number reflecting the patient's position in the queue. You are expected to see patients in the order in which their tokens were assigned, unless clinical circumstances require otherwise. You may also add walk-in patients directly through your bookings dashboard. Walk-in patients added by you are your sole responsibility and are managed separately from the online booking capacity of a slot.

Patient information shared with you through hApItal, including name, age, mobile number, and symptom description, is shared solely for the purpose of the consultation and must not be used for any other purpose or communicated to any third party. You may send re-checkup reminders to patients through the platform when a follow-up visit is clinically appropriate. These reminders must be used only for genuine clinical follow-up purposes and must not be used as a means of unsolicited commercial communication.

5. Prescriptions and Clinical Responsibility

Any prescription you issue through the hApItal platform is entirely your medical and legal responsibility. You must only issue a prescription following a genuine personal consultation with the patient. All prescriptions must comply with the applicable provisions of the Drugs and Cosmetics Act, 1940, the relevant rules thereunder, and the ethical guidelines issued by the National Medical Commission or the relevant State Medical Council. You must not prescribe controlled substances, narcotics, or scheduled drugs through the platform unless you are specifically licensed and qualified to do so under applicable law. hApItech provides the prescription delivery mechanism only and bears no responsibility whatsoever for the content, accuracy, or legal compliance of any prescription you issue.

You may also upload supporting documents — such as scanned prescriptions, lab reports, or medical certificates — to accompany a patient appointment. Any file you upload is stored in private encrypted storage and associated exclusively with the specific appointment it relates to. Patients can access these documents through secure time-limited links that expire after twenty-four hours. You must not upload any document that contains information unrelated to the patient's current appointment, and you must ensure that all uploaded content complies with applicable patient confidentiality obligations.

6. Fees and Payments

You set your own consultation fee on your hApItal profile and may update it at any time. During the current early access period, hApItech does not charge a commission on consultation fees collected through the platform. This may be subject to change in the future, and hApItech will provide at least thirty days' prior written notice before introducing any platform fee. Payments collected from patients are processed by Razorpay and settled to your registered bank account in accordance with Razorpay's standard settlement schedule. You are solely responsible for your own tax obligations, including income tax and Goods and Services Tax where applicable, on all earnings generated through the platform.

7. Notifications

By registering on hApItal, you agree to receive push notifications, SMS messages, and WhatsApp messages to your registered mobile number. These communications are limited to appointment-related activity, including new appointment bookings, patient cancellations, and relevant changes to your booking status. Notification preferences may be adjusted through your device settings. hApItech is not responsible for delays in notification delivery attributable to your mobile network or device settings.

8. Promotional Listings

Doctors may optionally participate in hApItal's paid promotional listing feature, which provides increased visibility within the patient-facing application. All promotional content is subject to review and approval by hApItech before it is displayed to patients. Promotional content that makes false, exaggerated, or unsubstantiated claims regarding qualifications, treatment outcomes, or medical capabilities will be rejected. hApItech does not guarantee any minimum number of appointment bookings or a specific level of patient reach as a result of participating in promotional listings. Promotional credits, once utilised, are non-refundable.

Participation in promotional listings is managed through a credit-based system. hApItech may allocate a number of promotional days and impression-based credits to your account through subscription plans or promotional offers. Credits are consumed on a per-day or per-impression basis as applicable, and your promotional listing will automatically pause when your balance reaches zero. Additional credits may be purchased through the billing section of your dashboard. The consumption of credits is tracked through anonymised interaction events recorded when your listing is displayed or interacted with in the patient application. You agree that hApItech's measurement of credit consumption is authoritative for billing purposes.

9. Patient Data and Confidentiality

Patient information made available to you through hApItal is confidential and must be handled with the strictest professional discretion. You may use such information solely for the purpose of providing healthcare services to the patient concerned in connection with the specific appointment. You must not share, disclose, sell, or otherwise transfer patient information to any third party under any circumstances. You are responsible for ensuring your own compliance with all applicable data protection and patient confidentiality obligations under Indian law, including the relevant guidelines issued by the National Medical Commission.

10. Prohibited Conduct

You agree not to misuse the hApItal platform. Prohibited conduct includes, but is not limited to, providing false or misleading medical credentials during registration, issuing prescriptions without having conducted a genuine personal consultation, soliciting patients to engage with you outside the platform following an initial hApItal-facilitated connection in order to circumvent platform usage, submitting or encouraging false reviews or ratings, using any automated means to manipulate your profile's ranking or visibility, misusing the re-checkup reminder feature for purposes other than genuine clinical follow-up, and engaging in any conduct that violates the ethical guidelines of the National Medical Commission or the relevant State Medical Council.

11. Account Suspension and Termination

hApItech reserves the right to suspend or permanently terminate your doctor account, with or without prior notice, in the event that false credentials are provided, credible patient safety concerns are raised, a sustained pattern of patient complaints is received, or you are found to be in breach of any of these terms. Termination of your account does not affect hApItech's right or obligation to retain appointment and prescription records for the periods required by applicable law. You may also request voluntary deactivation of your account at any time by contacting our support team.

12. Intellectual Property

hApItech grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the hApItal platform solely for its intended purpose of listing your practice and managing patient appointments. Nothing in these terms transfers any intellectual property rights in the hApItal platform, its design, software, data, or content to you. You may not copy, reproduce, reverse engineer, or use any aspect of the platform to develop a competing service.

13. Limitation of Liability

hApItech functions as a technology intermediary only and bears no responsibility for medical decisions, clinical outcomes, or acts or omissions of any doctor on the platform. hApItech is not liable for any medical negligence claim between you and a patient, for technical downtime affecting your ability to access the platform, for payment settlement delays attributable to Razorpay's systems, or for any indirect, incidental, or consequential loss of any nature arising from your use of or reliance on the platform. To the maximum extent permitted by applicable law, hApItech's aggregate liability to you shall not exceed the total platform fees, if any, paid by you in the three months immediately preceding the event giving rise to the claim.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, or controversy arising out of or in connection with these terms or your use of the hApItal platform shall be subject to the exclusive jurisdiction of the competent courts located in Palanpur, Gujarat, India. We encourage all parties to seek an amicable resolution through direct communication with our support team before initiating formal proceedings.
